The Nigerian Electricity Regulatory Commission (NERC) has expressed its disapproval at the planned review of the Electric Power Sector Reform (EPSR) Act 2005 by the Ministry of Power.
In a letter to President Goodluck Jonathan, which was copied the Minister of Power, Prof. Chinedu Nebo; Coordinating Minister of the Economy and Finance, Dr. Ngozi Okonjo-Iweala, and Bureau of Public Enterprises (BPE) amongst others, NERC stated that it was opposed to the planned review on the ground that it was not relevant to ongoing proceedings in government’s reform of the sector.
A source privy to the letter hinted that the commission, in the letter, intimated the president and all other concerned stakeholders of the possible import of the planned review of the eight-year old Act as well as the improper procedure with which the ministry was going about it.
The letter, THISDAY learnt, also conveyed to the president, extant lawful procedures involved in the review of such an Act, adding that as a regulator of the sector, it was not duly consulted on the planned review, which ordinarily should be done with its cooperation alongside other top government power policy think-tank.
